The Maine Bankruptcy Court’s recent Order approving the sale of the Clary Lake Dam is important for at least 2 principal reasons. One practical, one instructive. As a practical matter, the Clary Lake Association will now own the dam and that is a positive development in its own right for a multitude of reasons. For Maine bankruptcy practitioners, the Court’s ruling provides instructive guidance on the proper application of Section 363 of the Bankruptcy Code, particularly with respect to Section 363(f)(4) and (5).

10 years ago today, Lehman Brothers filed the largest US bankruptcy case in history and it is still pending a decade later. This week, Kai Ryssdal noted the truism that the next economic crisis is not a matter of if, but when. Thought this NY Times article offered some clues. Absolutely astonishing that student debt has more than doubled since 2008 to more than $1.5 trillion.
